Debt Collection Lawsuit Defense: Attorney Walton represented a World War II veteran who was sued on a defaulted Chase Bank credit card for approximately $5,000.00. Over a period of two years, Attorney Walton obtained a dismissal of the debt collection lawsuit, and filed a lawsuit in Federal Court against the debt collector for violations of the Fair Debt Collection Practices Act.

Default Judgments / Wage Garnishments: Attorney Walton represented a San Diego County resident who was served with a wage garnishment notice on a ten-year old default judgment. Attorney Walton prepared and filed a Motion to Vacate and negotiated a mutual walk-away settlement that resulted in the removal of the default judgment.

Debt Collection Lawsuit Defense: Attorney Walton represented a San Diego resident who was sued at approximately the same time by two debt buyers on three different revolving credit accounts. After litigating all three cases, Attorney Walton obtained a dismissal of one case filed by Midland Funding, LLC and negotiated a mutual walk-away settlement on the remaining two cases filed by Portfolio Recovery Associated, LLC.

Debt Collection Lawsuit Defense: Attorney Walton’s client was sued for approximately $6,000.00 by CACH, LLC on a defaulted GE Money Bank credit card account. After conducting discovery and preparing for trial, the account was settled for just ten percent (10%) of the total amount due.

Debt Collection Harassment / FDCPA: Attorney Walton’s client was subjected to threatening language by an employee of debt collector Mountain Lion Acquisitions, Inc. to the effect of “tell your wife to be expecting a garnishment” even though a debt collections lawsuit had never been filed. Eventually, a lawsuit was filed against the client, and Attorney Walton defended it pro bono. The cases were settled with a monetary payment to Attorney Walton’s client as well as a promise by both parties to dismiss their cases against each other.

Identity Theft Lawsuits: Attorney Walton’s client was sued by CACH, LLC on an identity theft account that resulted from fraud by the client’s former employer. After corresponding with CACH, LLC attorneys, the Mandarich Law Group, LLP, Attorney Walton was able to obtain a dismissal of the lawsuit.

Debt Collection Defense: Attorney Walton represented a local San Diego radio personality who was sued by BH Financial Services, LLC in the total amount of $21,874.73 on a defaulted Citibank credit card. After The Jake A. Walton Law Firm did a full pre-trial workup on the case, BH Financial elected to dismiss the case before trial, resulting in full debt relief for the client.

Debt Collection Defense – Auto Insurance Subrogation: Attorney Walton represented a client who was being pursued by State Farm Insurance and Reese Law Group for property damage that resulted from a collision between ATV’s in a desert area in Eastern San Diego County. Attorney Walton prepared correspondence explaining to State Farm that the client had a complete defense because the parties “assumed the risk” of participating in off-road racing activities. All collections efforts by State Farm were immediately terminated.
